In a 6-3 decision on Tuesday, June 30, the court ruled that individual states can enforce laws preventing transgender student-athletes from competing on female sports teams at public schools and universities. According to GiveMeSport, the ruling is expected to have far-reaching consequences, with more than two dozen states already having similar laws in place.

Supreme Court backs state bans

The case centered on legal challenges to state laws in Idaho and West Virginia, involving college student Lindsay Hecox and high school athlete Becky Pepper-Jackson. The justices concluded that the bans do not violate Title IX, the 1972 federal civil rights law designed to protect equal opportunities in education and athletics.

Justice Brett Kavanaugh wrote that state lawmakers and educational institutions are better positioned to weigh the medical and scientific considerations surrounding transgender participation in women’s sports.

The decision effectively allows states that choose to do so to prohibit transgender athletes from competing on girls’ and women’s teams, while states without such laws remain free to set their own policies.

Critics condemn the ruling

LGBTQ+ advocacy groups reacted strongly to the decision.

Jaymes Black, CEO of The Trevor Project, described the ruling as another attack on transgender youth, arguing that restrictions targeting transgender athletes continue to marginalize an already vulnerable community.

Supporters of the bans, however, say the ruling protects fairness and competitive integrity in women’s sports.

Trump celebrates “big win”

The decision represents a major political victory for President Donald Trump, who made banning transgender women from women’s sports a key issue during his 2024 presidential campaign.

Trump celebrated the ruling on Truth Social, cited by GiveMeSport, writing:

“BIG WIN: The United States Supreme Court just RULED AGAINST MEN PLAYING IN WOMEN’S SPORTS. Wow! That takes that ridiculous situation off the table!!!”

Last year, Trump signed an Executive Order aimed at clearly defining male and female based on biological reality. The White House has previously claimed that roughly seven in 10 Americans oppose transgender women participating in women’s sports. Trump has been unequivocal on the matter, previously stating his view that for transgender women in women’s sports, it should simply be banned and not allowed to happen, according to The White House. The Supreme Court has a history of backing Trump-enforced restrictions on transgender people, including a Pentagon policy that banned transgender individuals from serving in the military.
